Any capital building erected on your property will not be considered your property until it is registered in the Unified State Register of Rights to Real Estate and Transactions therewith (USRR). Currently, the so-called "summer amnesty" is still in effect, allowing you to register a house with a minimum number of documents and in a minimum amount of time.
What documents will be required to register at home
Law No. 93-FZ entered into force in September 2006, and has been extended until March 1, 2015. You should know that you can register buildings on your site only after your right to this land is registered. If you still do not have a Certificate of ownership of this land, you need to issue it. This can be done simultaneously with the registration of buildings. The necessary package of documents that you must provide to the authorities of Rosreestr will depend on the purpose of your site.
In the event that the land on which the house is built is intended for individual housing construction (IZHS) or is allocated for personal subsidiary plots (LPH), you need to provide for registration:
- application for registration of the building;
- cadastral passport for the building;
- title documents for the land plot, if the certificate is issued before 2002, a cadastral passport for the land plot must be attached to it. If the house is located on a plot intended for gardening or summer house construction, it will be necessary to fill out 2 copies of the declaration describing this house and attach a certificate of ownership of the land to it.
Which registration option to choose
At the same time, the usual procedure for registering buildings is also in force, implying the mandatory acceptance of the constructed house into operation. True, since 2010, the issuance of building permits and preparation of decisions on the acceptance of facilities into operation has been carried out by local administrations. Registration under such regulations may be required if your home will need to be connected to the main communication networks. Utilities simply refuse to issue permits to connect those buildings that were not accepted under the commissioning acts.
When your house is equipped only with autonomous communication systems, registration in accordance with the law on "summer amnesty" will be quite enough for you.
