Management companies, many out of the old habit, are called ZhEKs. In the process of reforming the public utilities sphere, the first to assume the functions of operating organizations, previously owned by ZhEKs. Many companies have retained this abbreviation in the names. But the Housing Code spells out the rights and obligations of the management companies. Owners of apartments have the full right to refuse the services of a non-arranging communal service.

Gather a general meeting. You can only part with a non-performing management company together. The Housing Code provides three options for managing multi-unit residential buildings. This may be a partnership of homeowners or the board of a cooperative, direct management or a management company, it is also a housing office. All three methods under Russian law are absolutely equivalent.

The procedure for choosing a management method and refusing the services of a management company, if you make such a decision at the end of the year, is approximately the same. The contract with the management company is concluded for no more than 3 years. It can be terminated by the owners unilaterally.

If you find it difficult to bring all apartment owners together, vote in absentia. Send the forms. Enter in them the text of the story of the general meeting. Indicate in it the question that the owners should consider - for example, the refusal of the services of a management company for such reasons. The reasons can be very different. The most popular is the discrepancy between the quality and cost of services. The text should be very short. For a decision to be competent, at least half of the owners must vote for it. Do not forget that the vote count is carried out in proportion to the square meters owned by one or another owner.

Write the minutes of the general meeting. Indicate the number of voters. Enter the text of the decision. Add the voting forms to the protocol.

You can terminate the contract with the housing office in the middle of the year. To do this, also take the decision of the general meeting. Write a collective complaint to the court. In the wording indicate that you are asking to terminate the contract due to the fact that the public service does not fulfill its obligations. Evidence that the contract is being implemented must be provided by the utility.

Having refused the services of one management company, make sure that the house does not remain without maintenance. You can choose another company, enter into direct agreements with suppliers of resources and utilities, create a partnership. If you yourself do not take care of yourself, the municipal administration will do it. In the absence of your decision, she will be required to conduct a tender and determine the winner.

If not all apartments are privatized in a house, then the municipality is usually the owner. In this case, the representative of the municipal property management committee votes at a general meeting for all residents living in apartments on a social hiring basis.
