Today, very often people ask such a question, since many open their small and large companies, for the normal functioning of which they need to attract other people as working personnel of the company. What document will be confirmed by the fact that you are an employer, and the person hired is an employee?
In most cases, this is an employment contract concluded between the employee and the employer. In some cases, the employer decides to formalize the employee by entering into another contract. What kind of document is this? This is a civil contract. In this contract, the employer has much less obligation than when concluding the contract described at the very beginning. And yet, how to decide which contract to draw up correctly? According to the employment contract, the employer undertakes to fulfill all the obligations imposed on him by the labor code, and the employee is obliged to fulfill his labor function. This agreement should contain the following information: firstly, the place of work should be described; secondly, the exact start date should be indicated; thirdly, the name of the position that the employee will occupy; fourthly, there must be rights and obligations that are assumed by both parties to the contract.
The civil contract stipulates that the parties themselves establish the duties and obligations imposed on them by the conclusion of this contract. Although there are cases in which the law still imposes certain restrictions. These cases are described in paragraph 4 of Art. 421 of the Civil Code of the Russian Federation. In addition, this agreement must necessarily contain information about the type of work performed, the exact amount of the fee or the exact order by which this amount will be charged.
To properly register an employee, you must:
1. To conduct a thorough analysis of the existing relationship between you and the employee.
2. Remember, you should not delay the drawing up of an employment contract, since under the law it can be executed within three days from the day the employee is allowed to work.
3. Decide on how long you want to fill out the employee.
