The primary organization is the initial link of the union. It is created at the enterprise, in an institution, organization from among employees and on their initiative. Union members represent and protect the interests of all employees of the enterprise, negotiate with management, take part in resolving labor disputes, etc. The rights, duties, responsibilities and features of the creation of the primary trade union organization are established by federal legislation.

Create an initiative group. It must include at least three employees of your company over the age of 14 who have Russian citizenship. Members of the initiative group can be both members of the trade union movement, and people who are just planning to join the union.

Do the preparatory work. The initiative group should communicate with the majority of the employees of the enterprise, find out their attitude to the idea of creating a primary trade union organization, collect and summarize complaints and suggestions on the organization of labor. Based on the comments of the workers, you can conclude that it is necessary to create a union link and the main directions of its activity.

Set a date and time for the constituent assembly. In order not to aggravate relations with the employer, spend it in a neutral territory after hours. Send the invitation to all employees, including managers. When inviting, convince colleagues, but do not insist on their presence. Participation in a trade union organization is an exclusively voluntary right of everyone.

Prepare the meeting agenda and draft constituent documents. The agenda should include the following main points: - creation of a primary trade union organization, selection of a branch trade union, registration of a legal entity; - election of the chairman of the primary organization, members of the trade union committee, members of the audit commission; - approval of the Regulation on the primary trade union organization.

Hold a constituent assembly at the appointed time. The members of the initiative group, which are the founders of the primary trade union organization, should make reports (messages) on the goals and objectives of the trade union, on the advantages and prospects of the primary organization in the enterprise.

Provide an opportunity for participants to ask all their questions. Be sure to discuss the need to register the primary organization as a legal entity. The law does not require this in categorical form. Primary organizations that do not form a legal entity transfer the right to keep their financial statements to the regional trade union. It is also important to choose the branch trade union, that superior link which will direct and supervise activity of your organization.

Familiarize participants in the meeting with the main points of the regulation on the primary trade union organization. It must be drawn up in accordance with applicable law. The provision must specify the goals, objectives, rights of the trade union, its obligations towards employees, the procedure for interacting with the employer, the mechanism for joining and leaving the union, the size of membership dues, the regularity of trade union meetings, etc.

Conduct a secret or open vote on each agenda item. The results of the meeting are reflected in the minutes. In it indicate the date, time, place of the meeting, the number of participants. List the issues discussed and the voting results. Attach a list of all workers present to the minutes.

Notify company management of the establishment of a primary union organization. Register the primary organization with the regional union council.

If a decision has been made to register a legal entity, contact the tax office at the location of your company within one month from the date of creation of the primary trade union organization. By all means, you must provide originals or notarized copies of the regulations on the primary trade union organization, the minutes of the constituent assembly, a list of union members.
