The main essence of public television is that it is independent and not subject to the state. However, in different countries there are still forms of public control. Special national legislation should govern public television. For example, the British corporation BBC is regulated by the Royal Charter. According to RIA Novosti, in Russia the composition of the OTV council will be approved by the president of the Russian Federation. The OTV Council is the governing body of the new channel. By the end of June 2012, a list of candidates for the council should be drawn up.

Studies have been conducted according to which about 30 percent of respondents are positive about the fact that the head of state will appoint a chief editor (general director). Most of them have a positive attitude towards the president and the ruling party. The opposite opinion is 24 percent of respondents. Opponents of OTV are of the opinion that the leader appointed by the president is already dependent on him; accordingly, such television cannot be public. About eighty percent of Russians declared themselves unwilling to pay dues for the maintenance of OTV.

It is assumed that the platform for the new channel will be the channel "Star". Members of the council, according to the decree of the president, must be appointed for a term of five years, participate in the activities of the channel on a gratuitous basis, elect the chairman of the council and deputies, meet at least once every three months. Civil servants, members of the public chamber, deputies and senators of the State Duma cannot become members of the council.
